These Terms of Use govern your access to and use of mayanmobilemarketing.com, its tools and content (the “Site”). By using the Site you agree to these Terms. If you do not agree, do not use the Site. Client engagements are governed by a separate written services agreement; where these Terms and a signed agreement conflict, the signed agreement controls.
1. Informational purposes; no guarantees
Content on the Site, including Mayan OP™ (the market opportunity and lead calculator), game plans, growth simulators and Mayan AI™, is provided for general information and illustration only. Figures are estimates derived from public population data and modeled benchmarks; they are not predictions, promises or guarantees of leads, rankings, traffic, revenue, advertising approval or any business outcome. Results vary by market, budget, competition, platform policies and your own operations. Nothing on the Site is legal, financial, medical, tax or professional advice.
2. Mayan AI™ and prototype tools
Automated scans and audits may be incomplete, delayed or inaccurate and depend on third-party data and publicly available signals. They are a starting point for a conversation with our team, not a certified technical report. You represent that you own or are authorized to submit any domain you enter.
3. Acceptable use
You agree not to misuse the Site, including by scraping, reverse engineering, introducing malware, submitting false information, interfering with its operation, or using it in violation of law. We may suspend or terminate access at our discretion.
4. Intellectual property
The Site, its design, text, graphics, logos, tools, code and content are owned by Mayan Mobile Marketing or its licensors and protected by copyright, trademark and other laws. Client names, logos and websites shown are the property of their respective owners and are displayed to identify work performed. You may not copy, reproduce, distribute or create derivative works without our prior written permission.
5. Third-party services and platforms
We reference and work with third-party platforms (such as Google, Meta, TikTok, LinkedIn and YouTube). We do not control and are not responsible for their availability, policies, pricing, approvals or changes, and we are not affiliated with or endorsed by them. Use of those platforms is subject to their own terms.
6. Testimonials, ratings and past results
Testimonials, ratings and milestones reflect individual experiences and historical results and are not a guarantee of future performance. Ratings displayed are as shown on the referenced platform at the time of publication.
7. Communications consent
By submitting a form you consent to be contacted by Mayan Mobile Marketing by phone, email or, where you opt in, SMS, regarding your inquiry. You may opt out at any time as described in our Privacy Policy.
8. Disclaimer of warranties
THE SITE AND ALL CONTENT AND TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAYAN MOBILE MARKETING AND ITS OWNERS, EMPLOYEES AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR BUSINESS, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT OR TOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold harmless Mayan Mobile Marketing from claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or information you submit.
11. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey without regard to conflict-of-law rules. Any dispute arising from the Site shall be brought exclusively in the state or federal courts located in Union County, New Jersey, and you consent to their jurisdiction. Any claim must be filed within one year after it arises.
12. Changes
